Submission of the Electricity Supply Provisions Related to the "Renewable energy power promotion surcharge"

In accordance with the "Feed-in Tariff Scheme for Renewable Energy" stipulated by the "Act on Purchase of Renewable Energy Sourced Electricity by Electric Utilities" (to be effective on July 1, 2012), we have submitted the changes to the Electricity Supply Provisions and the request for the approval of the supply conditions outside of the terms of Electricity Supply to the Minister of Economy, Trade and Industry.

Based on this "Feed-in Tariff Scheme for Renewable Energy", the purchase cost of power generated by renewable energy will be added to the electricity bill as "Renewable Energy Power Promotion Surcharge" for all customers (including those with high voltage/extra-high voltage contracts) starting from August 2012.

1. "Renewable Energy Power Promotion Surcharge"

(1) Outline
The "Renewable Energy Power Promotion Surcharge" is calculated based on the "unit price of Renewable Energy Power Promotion Surcharge" set every fiscal year according to provisions such as the "Act on Purchase of Renewable Energy Sourced Electricity by Electric Utilities", and will be added on customer's monthly electricity bill.

(2) Unit price of Renewable Energy Power Promotion Surcharge
The unit price of Renewable Energy Power Promotion Surcharge is set every fiscal year according to provisions such as the Act on Purchase of Renewable Energy Sourced Electricity by Electric Utilities (For example, announcement that sets unit price in accordance with Article 12 (2) of the Act on Purchase of Renewable Energy Sourced Electricity by Electric Utilities."). The following is the unit price to be applied to the electricity rates starting from August 2012.

(3) "Feed-in Tariff Scheme for Renewable Energy" and "Surplus electricity buyback program for the photovoltaic power generation"
The "Surplus electricity buyback program for the photovoltaic power generation" which came into effect in November 2009 based on the "Act on promoting the use of nonfossil energy resources and the effective use of fossil energy resources by energy supply utilities" will be replaced by the "Feed-in Tariff Scheme for Renewable Energy" from July, 2012. Since the timing of charging the purchase cost is different for these two systems, we request our customers to incur both "renewable energy power promotion surcharge" and "Solar Surcharge" during the transitional period (See Appendix). We greatly appreciate your understanding.

(4) Customers subject to exemption
Business operators using a huge amount of energy (government approval and notification to TEPCO required) and those afflicted by the Great East Japan Earthquake (notification to TEPCO required) are subject to exemption. The exemption from "Solar Surcharge" is only applicable for those afflicted by the Great East Japan Earthquake.

(5) Others
The Electricity Demand-Supply Provision applied to high voltage and extra-high voltage contracts has been revised as well on April 1, 2012.

2. Request to approve the supply conditions outside of the terms of Electricity Supply

(1) Exemption from Solar Surcharge
We have requested the Minister of Economy, Trade and Industry to approve supply conditions outside of the terms of Electricity Supply (special measures on electricity rate [Solar Surcharge ]) necessary to apply Solar Surcharge exemption to those afflicted by the Great East Japan Earthquake.

(2) Special measures concerning the demand site
Upon implementing the "Feed-in Tariff Scheme for Renewable Energy", we have requested the Minister of Economy, Trade and Industry to approve supply conditions outside of the terms of Electricity Supply (special measures on the demand site) to allow renewable energy purchase utilizing the dedicated service line. The supply conditions are applied to the approved power facilities specified in the Act on Purchase of Renewable Energy Sourced Electricity by Electric Utilities (those which fulfill the requirements).
